Terms of Service

By accessing or using Vibe Check (the "Service"), including the website at vibecheck.mobile and all related subdomains, you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and Uncanny Vibrations, LLC ("Company," "we," "us," or "our"), the operator of the Vibe Check service. "You" refers to any individual who accesses or uses the Service, whether as a host, player, or visitor.

We may update these Terms from time to time. We will notify you of material changes by posting the revised Terms on this page and, where required by law, by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

Vibe Check is a browser-based party game platform that allows hosts to run live trivia and social game sessions with players who join by entering a short room code on their devices. The Service includes:

• Quick Play. A host creates a game using a randomly selected question set from our content library. Players join via room code and participate in real time.
• Custom Sets (Pro/Lifetime). Pro and Lifetime subscribers may select from named question sets. Lifetime subscribers may create and manage their own custom question sets and tags.
• Dashboard. Hosts can view game history, milestones, themes, and account settings after signing in.
• White-Label (custom). A separate service offering custom branding and question sets for businesses and event organizers.

Players always participate free of charge. Players do not need an account to join a game. Hosting requires a registered account.

3.1 Registration

To host games, you must create an account by providing a valid email address and password. You represent that all information you provide is accurate, current, and complete. You agree to keep your account information up to date.

3.2 Account security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at support@vibecheck.mobile if you suspect unauthorized access to your account. We are not liable for losses arising from your failure to keep credentials secure.

3.3 One account per person

Each account is for a single individual. You may not share your account with others or create multiple accounts to circumvent plan limits or restrictions.

3.4 Age requirements

You must be at least 13 years of age to create an account. If you are between 13 and 18, you represent that you have obtained the consent of a parent or legal guardian to use the Service. We do not knowingly create accounts for children under 13.

4.1 Plans

We offer the following hosting plans:

• Free. No charge. Includes Quick Play with up to 15 players, limited to 1 game per day, and access to Game History, Host Tips, and the Atlanta theme.
• Pro. Monthly ($8/month) or annual ($70/year) subscription. Includes unlimited daily games, up to 100 players, custom question set selection, all city themes, and Milestones. Billed in advance.
• Lifetime. One-time payment of $199. Includes everything in Pro plus the ability to create and manage custom question sets and tags, unlimited players, and all future updates. Contact support@vibecheck.mobile to purchase.
• White-Label. Custom pricing starting at $499. Includes custom branding, your logo, and your question set. Contact us for details.

4.2 Billing and renewal

Pro subscription fees are billed in advance on a recurring basis (monthly or annually) through Stripe, our third-party payment processor. Your subscription renews automatically at the end of each billing period unless you cancel before the renewal date. You authorize us to charge your payment method on file for each renewal period.

4.3 Cancellation

You may cancel your Pro subscription at any time through your account settings or by contacting support@vibecheck.mobile. Cancellation takes effect at the end of your current billing period. You retain Pro access through that date and then move to the Free tier. We do not prorate or refund partial billing periods.

4.4 Refunds

All payments are non-refundable except as required by applicable law or expressly stated otherwise. If you believe a charge was made in error, contact us within 30 days of the charge at support@vibecheck.mobile and we will review your request.

4.5 Price changes

We reserve the right to change subscription prices at any time. We will provide at least 30 days' advance notice of any price increase via email. Continued use of the Service after a price change constitutes your acceptance of the new price.

4.6 Taxes

Prices are exclusive of applicable taxes. You are responsible for all taxes, levies, or duties imposed by taxing authorities on your subscription, excluding taxes on our income.

5.1 Scope

"User Content" means transient game inputs you provide while using the Service, including: (a) player names and aliases displayed during games; (b) free-text answers submitted during fill-in-the-blank rounds; and (c) messages, screenshots, or feedback you send to support. Question submissions for inclusion in the curated content pool are not covered by this section — those are governed by separate Question Submission Terms presented at the time of submission, if and when such a feature is offered.

5.2 License to Company

By providing User Content as defined above, you grant the Company a worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, display, and distribute that User Content solely for the purposes of operating, improving, and promoting the Service. This license ends when you delete your account, subject to content we may have shared or cached for routine operational and analytics purposes.

5.3 Content standards

You represent and warrant that your User Content: (a) does not violate any law or regulation; (b) does not infringe any third party's intellectual property, privacy, or publicity rights; (c) is not defamatory, obscene, harassing, threatening, or hateful; and (d) does not contain malware, spam, or deceptive content.

5.4 Content removal

We reserve the right (but not the obligation) to review, remove, or disable access to any User Content at our sole discretion, without notice, if we believe it violates these Terms or is otherwise objectionable.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Create accounts to circumvent plan limits, bans, or other restrictions.
• Attempt to gain unauthorized access to any part of the Service, our systems, or other users' accounts.
• Interfere with or disrupt the integrity or performance of the Service, including transmitting viruses, malware, or denial-of-service attacks.
• Scrape, crawl, or extract data from the Service without our express written permission.
• Reverse engineer, decompile, or otherwise attempt to derive the source code of the Service.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.
• Use the Service to transmit unsolicited commercial messages (spam) to players or other users.
• Use the Service in any manner that could damage our reputation or business.

7.1 Ownership

All content, features, and functionality of the Service — including the VIBE CHECK™ name and logo, game design and mechanics, question content created or curated by the Company, badges and awards, software and source code, graphics, text, images, audio, video, designs, and the overall "look and feel" of the Service (collectively, "Company Content") — are the exclusive property of Uncanny Vibrations, LLC, its licensors, or other content providers, and are protected by United States and international copyright, trademark, trade dress, patent, trade secret, and other intellectual property laws.

7.2 Trademarks

VIBE CHECK™, the VIBE CHECK logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Uncanny Vibrations, LLC. You may not use these marks without the Company's prior written permission. All other names, logos, product and service names, designs, and slogans appearing on the Service are the trademarks of their respective owners.

7.3 Limited license to users

Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for personal, non-commercial entertainment purposes. This license does not include any right to:

• Reproduce, duplicate, copy, sell, resell, or otherwise commercially exploit any portion of the Service or Company Content;
• Modify, adapt, translate, or create derivative works based on the Service or Company Content;
• Use any data mining, scraping, robots, or similar data-gathering or extraction methods;
• Reverse engineer, decompile, or disassemble any portion of the Service;
• Use the Service or Company Content to build a competing product or service; or
• Use Company Content for any commercial purpose without express written authorization from the Company (see Section 7.4 regarding B2B licensing).

7.4 B2B licensing

Bars, restaurants, event venues, corporate teams, brands, and other commercial entities wishing to use the VIBE CHECK™ name, logo, or service to promote events, host paid or ticketed gameplay, or run co-branded activations must obtain a separate B2B license from the Company. 7.5 Feedback

If you provide us with feedback, suggestions, or ideas about the Service ("Feedback"), you grant the Company an irrevocable, perpetual, royalty-free license to use, implement, and commercialize that Feedback without any obligation to you.

7.6 DMCA

The Company respects the intellectual property rights of others. If you believe content on the Service infringes your copyright, please send a notice in accordance with the Digital Millennium Copyright Act (17 U.S.C. § 512) to support@vibecheck.mobile with the subject line "DMCA Notice" and include: (a) identification of the copyrighted work; (b) identification of the infringing material and its location on the Service; (c) your contact information; (d) a statement of good-faith belief that the use is not authorized; (e) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on behalf of the copyright owner; and (f) your physical or electronic signature.

7.7 Reservation of rights

All rights not expressly granted to you in these Terms are reserved by Uncanny Vibrations, LLC and its licensors. Nothing in these Terms shall be construed as granting any license or right by implication, estoppel, or otherwise.

The Service integrates with third-party providers including Stripe (payments), Supabase (database and authentication), and Vercel (hosting). Your use of those services is governed by their respective terms and privacy policies. We are not responsible for the practices or content of third-party services.

The Service may contain links to third-party websites. These links are provided for convenience only. We do not endorse, control, or assume responsibility for any third-party website or its content.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR THAT DEFECTS WILL BE CORRECTED.

Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VIBE CHECK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $50 USD.

Some jurisdictions do not allow the limitation of liability for incidental or consequential damages, so the above limitation may not apply to you.

You agree to indemnify, defend, and hold harmless Vibe Check and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third party's rights.

12.1 By you

You may terminate your account at any time by contacting us at support@vibecheck.mobile. Termination does not entitle you to a refund of any prepaid subscription fees.

12.2 By us

We may suspend or terminate your account or access to the Service immediately, without notice or liability, if: (a) you breach these Terms; (b) we are required to do so by law; or (c) we reasonably believe termination is necessary to protect the Service, other users, or third parties. We may also discontinue the Service at any time upon reasonable notice.

12.3 Effect of termination

Upon termination, your right to use the Service ceases immediately. Sections 5.2, 7, 9, 10, 11, and 13 survive termination. We will handle your personal data upon termination as described in our Privacy Policy.

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Georgia, and you consent to personal jurisdiction in those courts.

Informal resolution. Before filing any claim, you agree to contact us at support@vibecheck.mobile and attempt to resolve the dispute informally for at least 30 days.

Class action waiver. To the extent permitted by applicable law, you agree to resolve disputes with us individually and waive any right to participate in a class action lawsuit or class-wide arbitration.

14.1 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vibe Check regarding the Service and supersede all prior agreements and understandings.

14.2 Severability

If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

14.3 Waiver

Our failure to enforce any provision of these Terms is not a waiver of our right to do so in the future.

14.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

14.5 Force majeure

We are not liable for any failure or delay in performance caused by circumstances beyond our reasonable control, including natural disasters, war, government actions, or internet outages.
